FAS Found Belgorodskaya Sbytovaya Kompania Violated Law
OREANDA-NEWS. On April 09, 2009 the Office of the Federal Antimonopoly Service in the Belgorod Region (OFAS Russia) found that "Belgorodskaya Sbytovaya Kompania" OJSC violated Part 1 Article 10 of the Federal Law "On Protection of Competition" (abusing dominant position), reported the press-centre of FAS Russia.
The Belgorod OFAS Russia initiated four antimonopoly cases against "Belgorodskaya Sbytovaya Kompania" OJSC upon petitions from "Korporativnye Servisnye Sistemy" OJSC, "Mekhkolonna No.77" OJSC, "ATP_Energia" Ltd., and "Belgorodenergoremont" OJSC. In their petitions the companies pointed out that "Belgorodskaya Sbytovaya Kompania" OJSC had unreasonably refused to sign contracts for buying and selling electric power.
As the ground for its refusal to sign contracts for buying and selling electric power, "Belgorodskaya Sbytovaya Kompania" OJSC indicated the circumstances that are not specified by the Regulations on Retail Markets of Electric Power in the Transitional Period of Reforming the Electric Power Industry (approved by No.530 Decree of the Government of the Russian Federation of 31st August 2006).
Having investigated the cases, the Belgorod OFAS Russia issued a determination to the energy supplying company requesting it to eliminate the antimonopoly violations. The Belgorod OFAS Russia also initiated a cases under Article 14.31 of the Code of the Russian Federation on Administrative Violations, which provides for imposing an administrative fine upon legal entities in the amount from one hundredth to fifteen hundredth of the proceeds gained by the violator form selling goods on the market where the violation was committed.
