OREANDA-NEWS. On April 07, 2009 the Federal Antimonopoly Service (FAS Russia) found that the Council of People's Deputies of the Kemerovo region (the legislature) violated Part 1 Article 15 of the Federal Law "On Protection of Competition", reported the press-centre of FAS Russia.

FAS Russia established that the Governor of the Kemerovo region signed No.140-OZ Regional Law "On Prohibiting Acceptance of Scrap Metal and Nonferrous Waste" of 29th December 2008, which prohibited acceptance of scrap metal and nonferrous waste in the Kemirovo region. Thus, the authorities of the Kemerovo region violated the antimonopoly legislation by passing an act that led or could have led to preventing, restricting or eliminating competition and prohibited or restricted certain types of economic activities.

Also, under Article 13.1 of the Federal Law "On Industrial and Consumer Waste", physical persons can alienate, in accordance with the procedures established by the legislation on the Russian Federation, scrap metal and nonferrous waste, generated in household use of non-ferrous products that are owned by those physical persons; and legal entities and individual entrepreneurs can handle and alienate scrap metal and nonferrous waste provided they have documents confirming their right of ownership for the scrap metal and nonferrous waste.

FAS Russia's Commission received information from the General Prosecutor's Office of the Russian Federation and the Council of People's Deputies that on 6th March 2009 the authorities the Kemirovo region passed No.21-OZ Regional Law "On Annulment No.140-OZ Regional Law "On Prohibiting Acceptance of Scrap Metal and Nonferrous Waste" of 29th December 2008.

Having investigated the case, FAS Russia found that the Council of People's Deputies of the Kemerovo region violated the antimonopoly legislation but did not issue a determination due to voluntary elimination of the violations in course of the case investigation.
