FAS Fined Helicopter Service Company and Military-Industrial Company
OREANDA-NEWS. April 06, 2009. The Federal Antimonopoly Service (FAS Russia) imposed administrative charges upon "Vertoletnaya Servisnaya Kompania [Helicopter Service Company]" OJSC and "Voenno-Promyshlennaya Kompania [Military-Industrial Company]" CJSC and the companies 300 000 Rubles each for concluding transactions without prior approval by the antimonopoly authority, reported the press-centre of FAS Russia.
FAS Russia received a petition of "Helicopter Service Company" OJSC on purchasing 95.06% of voting shares of "Novosibirsk Aircraft Repair Plant" OJSC and a petition of "Military-Industrial Company" CJSC on purchasing 72.6% of voting shares of "Radiophisika" OJSC.
Examining the above petitions and the documents presented upon requests, FAS Russia established that the transactions, applied for in the petitions, had been completed before the petitions were filed to the antimonopoly body.
Thus, "Helicopter Service Company" OJSC and "Military-Industrial Company" CJSC violated Part 1 Article 28 and Part 2 Article 32 of the Federal Law "On Protection of Competition" because the companies breached the petition-filing procedures provided for in the antimonopoly legislation.
Under Part 3 Article 19.8 of the Code of the Russian Federation on Administrative Violations, legal entities that breached the petition-filing procedures provided for in the antimonopoly legislation shall be administratively charged in the form of a fine from 300 000 to 500 000 Rubles.
