OJSC "Passenger Port" Imposed Unfavorable Сontract Сonditions
OREANDA-NEWS. April 01, 2009. The Federal Antimonopoly Service (FAS Russia) found that "Passenger Port" OJSC violated Article 10 the Federal Law "On Protection of Competition" (abusing dominant position) and issued a determination to eliminate the violations, reported the press-centre of FAS Russia.
The case was initiated upon a petition of "Rechflot. The Agency for Tourism and Services" Ltd.
"Passenger Port" OJSC violated the law by imposing unfavorable contract conditions upon a counteragent; fixing economically, technologically and otherwise unjustified different prices (rates) for the same goods; and creating discriminatory conditions.
FAS Russia, jointly with its Moscow Office and the Moscow Regional Office, has analyzed competitive environment on the market of the services provided by "Passenger Port" OJSC on providing the piers on the Moscow River in the Moscow city area and in the Moscow region within the boundaries of the Moscow canal for the use by the passenger riverboats. FAS Russia and its Offices have also аanalyzed the level of competition on the market of passenger transportation by inland water transport on the Moscow River in the Moscow city area and in the Moscow region within the boundaries of the Moscow canal. "Passenger Port" OJSC has dominant position on both markets, with the market share over 50%.
FAS Russia brought into proceedings the following entities that have information about the circumstances investigated by the FAS Russia's Commission: the "Gormost" State Unitary Enterprise, the Moscow City Office of the Federal Agency for Federal Property Management, the Moscow Regional Office of the Federal Agency for Federal Property Management, the Association of Ports and the Owners of River Transport Vessels, the "Moscow Canal" Federal State Unitary Enterprise, the Federal Transportation Inspection Service, "Russkaya Parokhodnaya Kompania Na Payakh" CJSC and the Moscow City Property Department.
Having investigated the case, FAS Russia issued a determination to "Passenger Port" OJSC requesting the company to stop violations of the antimonopoly legislation.
