FAS Found Complaint of Regional Evaluation Agency Was Ungrounded
OREANDA-NEWS. April 01, 2009. The Federal Antimonopoly Service (FAS Russia) processed a case against the Ministry of Defence of the Russian Federation and found that the complaint of "Regional Evaluation Agency [Regional'noye Agenstvo Otsenki]" Ltd. was ungrounded, reported the press-centre of FAS Russia.
According to the Petitioner, the Ministry of Defence violated the Federal Law "On State and Municipal Procurement of Goods, Works and Services" in organizing a public tender for selecting an executor to evaluate market value of 100% - 1 share of the open share-holding companies, reorganized from the federal state unitary enterprises subordinate to the Ministry of Defence of the Russian Federation.
In its petition "Regional Evaluation Agency" Ltd. stated that the Bids Opening Protocol had not mentioned the company's bid. "Regional Evaluation Agency" Ltd. sent its bid to the Ordering Party by DHL Express. When the FAS Russia's Commission was investigating the complaint, the Ordering Party explained that in accordance with the Bids Opening Protocol of 6th March 2009, the information on the received bid for state procurement was consistent with the "Journal of Received Bids", which was kept in the form for record management established by the Ordering Party. The Tender Commission received the bid of "Regional Evaluation Agency" Ltd. on 10th March 2009; that is, after the deadline for filing the bids (10 a.m. on 6th March 2009).
Under Clause 10 Article 26 of the Federal Law "On State Procurement…", the bid of "Regional Evaluation Agency" Ltd., received after the deadline for filing the bids, was opened and on the same day the envelope and the bid were returned to "Regional Evaluation Agency" Ltd. by post.
Having investigated the petition, FAS Russia found the complaint ungrounded.

94-FZ Federal Law "On State and Municipal Procurement of Goods, Works and Services" came into force in January 2006.
The Law is aimed at increasing transparency of state and municipal procurement, and preventing corruption and abuse to determine the best conditions for execution of governmental contracts. The main objective of the Law is to save state budgetary funds.
In 2008 enforcement of the Federal Law "On State Procurement…" saved the state budget around 260 billion Rubles, in 2007 -168 billion Rubles, and in 2006 -106 billion Rubles.
