OREANDA-NEWS. March 30, 2009. The Krasnodar Regional Arbitration Court dismissed the claim of "Lukoil-Yugnefteproduct" Ltd. and upheld the decision of the antimonopoly body, reported the press-centre of FAS Russia.

In 2008 the Krasnodar Office of the Federal Antimonopoly Service (Krasnodar OFAS Russia) initiated an antimonopoly case against economic entities involved in retail sales of oil products in the municipalities - Armavir and Yeisk.

Having investigated the case, on 12th September 2008 the Commission of the Krasnodar OFAS Russia found that "Lukoil-Yugnefteproduct" Ltd. violated Clause 1 Part 1 Article 11 of the Federal Law "On Protection of Competition". The company was engaged in anticompetitive actions by fixing and maintaining retail prices for motor petrol (grades Аi-92, Аi-95) and diesel fuel. "Lukoil-Yugnefteproduct" Ltd. sold the products through a petrol station, location within the boundaries of a municipality - Armavir, for a price at the same level with the prices fixed by "Rosneft-Kuban'nefteproduct" Oil Company" OJSC and "Crocus" Ltd.

The Krasnodar OFAS Russia issued determination to the participants of the retail market of motor petrol (grades А-76, Аi-92, Аi-95) and diesel fuel within the boundaries of the following municipalities - Armavir and Yeisk, including "Lukoil-Yugnefteproduct" Ltd., requesting them to stop the antimonopoly violations.

"Lukoil-Yugnefteproduct" Ltd. appealed the decision and determination issued by the Krasnodar OFAS Russia to the Krasnodar Regional Arbitration Court. The Court dismissed the company's claim and upheld the decision of the antimonopoly body.
