FAS Russia Does Not Delay Decision on Petitions
OREANDA-NEWS. March 18, 2009. Due to information in mass media on delays with processing petitions, the Federal Antimonopoly Service (FAS Russia) finds it necessary to announce the following, reported the press-centre of FAS Russia:
The petition of "Mechel" on buying 75% of shares of TGK-11, which was received by the antimonopoly body in April 2008, was processed within the statutory period: the decision on the petition was adopted on 7th May 2008. Due to a technical error, however, the decision was placed on the FAS Russia's official web site under a wrong date - 13th March 2009. Currently, the error has been corrected. FAS Russia apologizes for the introduced error.
Under the Federal Law "On Protection of Competition", the antimonopoly body must process petitions within thirty days; the processing period can be extended to ninety days if it is necessary to obtain additional materials.
Furthermore, in December 2008, in view of the current situation, FAS Russia made a decision to review the petitions within the shortest period - thirty days - and apply possibility of extending the processing period up to ninety days only in cases of emergency. Relevant instructions have also been sent to the regional antimonopoly bodies.
