OREANDA-NEWS. March 16, 2009. the Federal Antimonopoly Service (FAS Russia) found that the Ministry of Finances of the Russian Federation violated the Federal Law "On State and Municipal Procurement of Goods, Works and Services" and issued a determination to eliminate the violations, reported the press-centre of FAS Russia.

Earlier FASA Russia was approached by the "ROSTEK" Federal State Unitary Enterprise. The Petitioner stated that the Ministry of Finances of the Russian Federation unlawfully rejected the company's tender bid for the services on technical control and supervision, project commissioning, and the services related оto executing and obtaining initial permit documentation.

The Petitioner also stated that according to the Bids Consideration Protocol, the Petitioner's bid did not meet the requirements of the tender documentation due to a failure to present a document confirming license conversion for constructing buildings and structures of the I and II importance level.

Рhaving investigated the case, FAS Russia found the complaint of the "ROSTEK" Federal State Unitary Enterprise justified.

The Petitioner's bid included a notary certified copy of the license for constructing buildings and structures of the I and II importance level valid till 23rd April 2012. The bid included an information letter from "ROSTEK" of 11th February 2009 on changing the company location and forwarding the company's license for conversion under the Federal Law "On Licensing Certain Activities".

FAS Russia issued a determination to cancel the Bids Consideration Protocol and to reconsider the bids in accordance with the state procurement legislation. In the opinion of the Antimonopoly Service, intentional reduction of the number of bidders could have eliminated competition and increased the contract price.
