Advertisement of «Green Mark» Vodka Was Unfair
OREANDA-NEWS. March 11, 2009. The Federal Antimonopoly Service (FAS Russia) found that the advertisement of the "Green Mark" vodka - "The No.1 Vodka in Russia" was unfair. The advertisement violated Clause 1 Part 2 Article 5, Clause 1 Part 2 Article 5 and Part 7 Article 5 of the Federal Law "On Advertising", reported the press-centre of FAS Russia.
The Antimonopoly Service issued a determination to the advertiser - "Glavspirittrest" Ltd. - to stop distributing the advertisement.
The advertisement of vodka was displayed on the advertising structures in the point-of-sales of alcoholic products in the Moscow stores of the "Perekryostok", "Sed'moi Continent", "Magnolia" and "Ramstor" retail chains.
FAS Russia initiated the case on violation of the legislation of the Russian Federation on advertising upon a petition of "RUST INCOPORATED" CJSC, which requested FAS Russia to recognize that the advertisement was unfair, containing incorrect comparison of the advertised goods, and untrue information about the advantage of the "Green Mark" vodka.
According to the protocols of testing samples of alcoholic products in the accredited laboratories of the "Centre for Testing and Certification - St Petersburg" Federal State Institution and the " Centre for Testing of Goods (Products), works and Services " St Petersburg State Institution, physical and chemical characteristics of the "Green Mark" vodka do not excel similar characteristics of the products under other brands.
Silver treatment technology and special method of corkage of the "Green Mark" vodka also do not give qualitative advantage over other brands of vodka on the market. Other producers use similar methods of treatment and individually designed corkage systems.
Upon recognizing the violation, the case file is transferred to a FAS Russia official to initiate administrative proceedings against "Glavspirittrest" Ltd.
