OREANDA-NEWS  On 20 February was announced, that Federal Antimonopoly Service (FAS Russia) published this press-release:

The Federal Arbitration Court of the Moscow District upheld the ruling of the 9th Arbitration Appeal Court and the Moscow Arbitration Court, and dismissed the cassation appeal. Therefore, the Court recognized that the Antimonopoly Service had lawfully terminated the case against several entities, initiated upon a petition of "Rezonans" Research and Production Enterprise" Ltd.

In 2007 the Federal Antimonopoly Service (FAS Russia) initiated antimonopoly proceedings against the Technical Society, the Engineering Consulting Centre, of Baltiisky State Technical University named after Ustiniv; "Yauza-10" Ltd., "KROS" Engineering-and-Technical Centre" CJSC, "EGO" Research and Production Enterprise" Ltd., "АSKB" Research and Production Enterprise" Ltd., "Аrzamass Instrument-Making Plant" OJSC, "Novosibirsk Plant named after Komintern" Federal State unitary Enterprise, and "TEKHCRANENEWRGO" Production Association" CJSC. The case was initiated upon a petition of "Rezonans" Research and Production Enterprise" Ltd. According to the Petitioner, the companies violated the law by disseminating a Joint Statement regarding "Rezonans", which contained the following information: "without relevant testing and permits, "Rezonans" Research and Production Enterprise" Ltd. produces various modifications of the instruments that reasonably raise serious doubts about safe operation of weight carrying cranes". In its petition, "Rezonans" Research and Production Enterprise" Ltd. emphasized that the information given in the Joint Statement was false and harmed the company's business reputation.

On 4th April 2008 FAS Russia concluded to close the case because the Joint Statement had not violated the antimonopoly legislation.

"Rezonans" Research and Production Enterprise" Ltd. challenged the decisions of the Antimonopoly Service in the Moscow Arbitration Court, which on 18th July 2008 dismissed the claim of "Rezonans" Research and Production Enterprise" Ltd.

"Rezonans" Research and Production Enterprise" Ltd. appealed the ruling of the Moscow Arbitration Court. On 24th November 2008, however, the 9th Arbitration Appeal Court upheld the ruling of the Arbitration Court of the First instance and dismissed the appeal.

Finally, on 16th February 2009, the Federal Arbitration Court of the Moscow District upheld the rulings of the Courts of lower instances and dismissed the cassation appeal.
