FAS and EuroChem Agreed Rules on Access to Apatite Concentrate
OREANDA-NEWS. On January 16, 2009 the Federal Antimonopoly Service (FAS Russia) and "EuroChem" Mineral and Chemical Company" OJSC, that functions as the sole executive body of "Kovdorsky Mining-and-Processing Integrated Works" OJSC, agreed the rules on non-discriminatory access to apatite concentrate produced by "Kovdorsky Mining-and-Processing Integrated Works" OJSC, reported the press-centre of FAS Russia.
"Kovdorsky Mining-and-Processing Integrated Works" OJSC will be selling no less than 200000 tons of apatite concentrate per year in accordance with the rules for external counteragents, not affiliated with the group of "EuroChem" Mineral and Chemical Company" OJSC.
The rules have been agreed within the scope of executing the determination issued by FAS Russia in October 2008 upon processing the case on violating Article 10 of the Federal Law "On Protection of Competition" by the group of persons including "EuroChem" Mineral and Chemical Company" OJSC and "Kovdorsky Mining-and-Processing Integrated Works" OJSC, who created discriminatory conditions for entry of "GMZ" Trading House" Ltd. to the apatite concentrate market.
After the conditions for regulating sales of apatite concentrate produced by "Kovdorsky Mining-and-Processing Integrated Works" OJSC are agreed, FAS Russia has no claims to "EuroChem" Mineral and Chemical Company" OJSC and "Kovdorsky Mining-and-Processing Integrated Works" OJSC regarding their execution of the determination issued by the antimonopoly body.
