OPUS TD Violated Law on Protection of Competition
OREANDA-NEWS. On January 19, 2009 the Federal Antimonopoly Service (FAS Russia) found that "OPUS TD" Ltd. violated Part 3 Article 11 of the Federal Law "On Protection of Competition" (concerted actions) and issued a determination to eliminate the violations, reported the press-centre of FAS Russia.
Being one of the largest Russian wholesale sellers of linoleum and other floor covering, "OPUS TD" Ltd. coordinated price policy of its counteragents. The company requested that stores and sales outlets must set definite, so-called "recommended" prices on the products obtained from "OPUS TD" Ltd., otherwise "OPUS TD" Ltd. would terminate the contracts and stop supplies.
"OPUS TD" Ltd. admitted its fault in full and informed FAS Russia on stopping the practice of imposing "recommended" prices upon its counteragents.
Based on its decision, FAS Russia will issue a determination to "OPUS TD" Ltd., with instructions on particular actions that the company will have to perform in order to eliminate the consequences of the antimonopoly violation. "OPUS TD" Ltd. expressed its readiness to execute the determination in full and cooperate with the antimonopoly bodies in the future.
Part 3 Article 11 of the Federal Law "On Protection of Competition" prohibits coordination of economic activities of market participants by physical persons, commercial and non-commercial organizations, if such a coordination results or can result in fixing or maintaining prices, and imposing unfavorable contract conditions upon counteragents.
