FAS Fined Rosneft
OREANDA-NEWS. On January 14, 2009 the Tambov OFAS Russia fined "Rosneft" Oil Company" OJSC 45 077 000 Rubles for entering into a concession agreement, certain provisions of which contravened the antimonopoly legislation, reported the press-centre of FAS Russia.
On 17th November 2009, the Tambov OFAS Russia found that "Rosneft" Oil Company" OJSC and "Tambovnefteproduct" CJSC violated Clause 3 Part 1 Article 11 of the Federal Law "On Protection of Competition" (competition-restrictive agreements or concerted actions ob economic entities) and issued a determination on excluding the provisions, that violated the antimonopoly legislation, from the concession agreement.
The franchising agreement included a provision according to which "Tambovnefteproduct" CJSC must agree with "Rosneft" Oil Company" OJSC the list of suppliers, from whom the company buys the oil products under the trademark of "Rosneft" Oil Company" OJSC for selling at the fueling stations.
Imposing the fine, the Tambov OFAS Russia took into account the company's economic position and the fact that the parties terminated the concession agreement. Executing the decision of the Tambov OFAS Russia and the determination, issued in accord with the decision, will facilitate stabilization of the situation on the market of oil products.
Under Article 14.32 of the Code of the Russian Federation on Administrative Violations, if an economic entity concludes a competition-restrictive agreement, forbidden by the antimonopoly legislation of the Russian Federation, or is engaged in competition-restrictive concerted actions, forbidden by the antimonopoly legislation of the Russian Federation, it is punishable by imposing an administrative fine upon legal entities - from 1% to 15% of the proceeds gained by the violator from selling goods on the market where the violation occurred.
