OREANDA-NEWS. January 14, 2009. According to FAS Russia, advertising dietary supplements as medicines and unfair advertising of medical services are the most widespread and socially dangerous violations of the legislation on advertising. Therefore, the Antimonopoly Authority is especially concerned with such advertisements, reported the press-centre of FAS Russia.

For instance, on 11th January 2009, the Federal Antimonopoly Service (FAS Russia) pronounced that the following advertisements were improper: advertisements of medical services by "RHANA Clinic" Ltd., "Uro-Pro" International Medical Centre" Ltd., drugs - "CosmoFer", "Osteoline" group of drugs, and the "Iridium" Trading Centre. The advertisers - "Delovoi Mir" Publishing House" Ltd., "Cosmopharm" Ltd., "Alexandr SM" OJSC, "Oasis" Ltd., "VGTRK" VGUP and "Video International - Radio" CJSC - were issued determinations to stop violating the advertising legislation.

"RHANA Clinic" Ltd. and "Delovoi Mir" Publishing House" Ltd. advertised medical services of "RHANA Clinic" in the "Krasota&Zdorovye" magazine - No. 12 (93) December 2007 (p. 25) and No.4 (97) April 2008 (p. 27). The advertising module included information directly indicating health improvement as a result of using the object of advertising.

The advertising module also did not contain the statutory warning (Part 7 Article 24 of the Law "On Advertising"). In another advertising module the space of the statutory warning was smaller than required by the law. FAS Russia pronounced both advertisements improper and issued determinations to "RHANA Clinic" Ltd. and "Delovoi Mir" Publishing House" Ltd. to stop the violations.

"Uro-Pro" International Medical Centre" Ltd. and "Delovoi Mir" Publishing House" Ltd. advertised medical services of "Uro-Pro" International Medical Centre" in the "Krasota&Zdorovye" magazine - No. 12 (93) December 2007 and No.4 (97) April 2008. In violation of Part 7 Article 24 of the Federal Law "On Advertising", the space of the statutory warning was smaller than required by the law.

FAS Russia found the advertising improper. "Uro-Pro" International Medical Centre" Ltd. and "Delovoi Mir" Publishing House" Ltd. were issued determinations to stop the violations.

Having investigated the case, initiated upon a petition of "Rhythm-Trust" Ltd. against "Cosmopharm" Ltd. for advertising "CosmoFer" in No.1, 2008, "Nefrologia i Dializ" magazine, FAS Russia found the advertisement improper. Contrary to Clause 2 Part 3 Article 5 of the Federal Law "On Advertising", the advertisement contained incorrect information on application conditions of "CosmoFer". FAS Russia did not issue a determination to "Cosmopharm" Ltd. because the company duly added the application conditions of the medicine, so the information on the application conditions of the medicine became true.

Having investigated the case initiated upon a petition of "El Punto" Ltd., FAS Russia pronounced that the advertisement of the "Iridium" Trading Centre, disseminated by "Alexandr SM" OJSC in July-August 2008, was improper. Contrary to Clause 3 Part 3 Article 5 of the Federal Law "On Advertising", the advertisement contained incorrect information about possibility to buy goods with the "OGGI" trade mark in the "Iridium" Trading Centre. FAS Russia issued a determination to "Alexandr SM" OJSC to stop the violations.

FAS Russia pronounced that the advertisement of "Osteoline" dietary supplements, disseminated by "Oasis" Ltd., "VGTRK" VGUP and "Video International - Radio" CJSC on "Radio Rossii", was improper. The advertisement created an impression that "Osteoline" dietary supplements had medical properties for treating dysfunctions and diseases of skeleton and bone and cartilaginous tissues, which violated Clause 1 Part 1 Article 25 of the Federal Law "On Advertising". FAS Russia issued determinations to "Oasis" Ltd., "VGTRK" VGUP and "Video International - Radio" CJSC to stop the violations.
