Federal Antimonopoly Service Supported Position of Belgorodenergo
OREANDA-NEWS. On 23 December 2008 was announced, that Belgorod AFAS performed legal investigation concerning "Interregional Distribution Grid Company of Centre", JSC (Belgorod branch) by the signs of infringement of part 1 of article No.10 -FZ 'On competition protection". The proceedings were initiated by statements of Belgorod Power Sale Company, JSC (BPSC, JSC).
In its statements BPSC, JSC specified that Belgorodenergo, a branch of IDGC of Centre, JSC, repeatedly notified the power sale company on possible partial suspension of rendering of services in electricity transmission and capacity in case of nonredemption of he existing debts.
From its part IDGC of Centre, JSC gave necessary materials including the contract with BPSC, JSC, according to which the branch of IDGC of Centre, JSC undertakes to render services in electricity transmission, and BPSC, to pay for electricity in the manner established in the contract.
Despite the contract provisions signed by both parties, BPSC, JSC has considerable debts to IDGC of Centre, JSC for the rendered services.
Having considered the materials presented by the network company, AFAS did not find out the facts specifying any actions on imposing of unprofitable contract provisions on rendering of services in electricity transmission concerning Belgorod Power Sale Company, JSC.
On the basis of the presented arguments the antimonopoly service defined that the arisen disagreements are of economic character connected with enterprise activity and are within the competence of the Arbitration Court.
Having summed up all the proofs of IDGC of Centre, JSC to be proved and lawful, AFAS made the decision on termination of the proceedings.
