OREANDA-NEWS. December 22, 2008. The Antimonopoly Committee considers coordinated actions with regards to concluding of joint contract for supplies of coal to energy-generating companies will lead to reduction of competition and monopolization of the coal market. Concluding of the document envisages introduction of single coordinated prices for coal, distribution of market between coal-mining enterprises and fixes Vyhillya Ukrayiny (Coal of Ukraine) state enterprise as a single supplier of coal production.

On considering a request concerning coordinated actions of members of the coal market the Antimonopoly Committee defined that their combined market share exceeds 35%. Consequently, coordinated actions would lead to restriction of competition and monopolization of the coal market, so the AMC prohibited concluding a joint agreement.

“Protection of economic competition is the main task for the Antimonopoly Committee of Ukraine. We have no right to afford the participants of wholesale market to conclude this agreement. As the result of such coordinated actions will be price competition on the coal market and creating restrictions concerning independent activity of the market players while leading their business. The decision of the AMC is based exceptionally on law’s provisions,” acting Head of Antimonopoly Committee Olexandr Melnychenko said on commenting the approved decision.
