OREANDA-NEWS. December 15, 2008. The Federal Antimonopoly Service (FAS Russia) and its regional offices must be more robust in cooperation with the law enforcement bodies to better control state and municipal procurement, stated Vasily Gorbunov, the Deputy Head of the Department for State Procurement Control at the seminar of the Heads of the regional antimonopoly bodies, reported the press-centre of FAS Russia.

According to Mr Gorbunov, "trustbusters" must develop criteria, under which cases, initiated for breaching the state procurement legislation, must be referred to the law enforcement bodies for further investigation.

In particular, Vasily Gorbunov suggested that case files should be referred to the police or the prosecutor's office in the following situations:

- When FAS Russia discovered violations of the state procurement legislation and issued a determination to eliminate the violations. However the goods were supplied, works were completed fully or partially, and services were provided in breach of the FAS Russia's determination;

- When the bidding takes place post factum, after the goods were supplied, works were completed, and services were provided;

- When the winner of the bidding is a company, whose bid was considerably worse than the bids of its competitors;

- When the ordering party or the bidders face a direct threat of frustrating the bidding or attempting to conspire a collusion.

Discussing the most widespread violations of state procurement, the Deputy Head of the FAS Russia's Department for State Procurement Control emphasized yet another type of violations that also deserves attention of the law enforcement bodies.

In tenders and auctions for large sums, the bidders sometimes find themselves in a situation when important pages disappear from the numbered and sewn together documents, prepared by the bidders, and their bids are rejected. Vasily Gorbunov suggested that in such situations the bidders should play safe and notarize the number of documents in the tender documentation.
