Ministry of Electric-Power Industry Violated Federal Law
OREANDA-NEWS. December 12, 2008. The Federal Antimonopoly Service (FAS Russia) recognized that the Ministry of the Electric-Power Industry of the Russian Federation violated the Federal Law "On State and Municipal Procurement of Goods, Works and Services" and issued a determination to eliminate the violations, reported the press-centre of FAS Russia.
FAS Russia was approached by "Energoaera" MEP" Ltd., which claimed that the Ministry unlawfully rejected the company's bid for participating in the tender for the governmental contract on developing a working project "Out-of-district water supply network of Sinegorsky settlement", under the adjusted project for liquidation of "Krasnodonetsk" Mine Office" OJSC.
FAS Russia found the complaint justified.
Also, investigating the case, FAS Russia established that the tender documentation did not contain the statutory requirements on the quality, characteristics and the outcome of the works, and did not specify the procedures for bids evaluation and comparison, which was in breach of Article 22 and Article 65 of the Federal Law "On State Procurement…". Furthermore, contract price offer made by a bidder did not have the breakdown of the overall price of the governmental contract by the types of work, which contravened Article 25 of the Federal Law.
Having investigated the case, FAS Russia issued a determination to the Ministry of the Electric-Power Industry of the Russian Federation requesting it to eliminate the violations of the state procurement legislation and initiated an administrative case against the Ministry's officials.
