FAS Fined SibirEnergo for Abusing Dominant Market Position
OREANDA-NEWS. December 10, 2008. The Novosibirsk Office of the Federal Antimonopoly Service (OFAS Russia) fined "SibirEnergo" OJSC for abusing dominant market position, reported the press-centre of FAS Russia.
"SibirEnergo" OJSC unreasonably refused to exclude advance payments from the contract for supply-and-consumption of electrical energy with "Dom na Oktyabrskoi [The House of Oktaybrskaya Street]" Housing Cooperative. There are no provisions in the current legislation on intermediary payment for utilities, including electrical energy supply.
Part 1 Article 10 of the Federal Law "On Protection of Competition" prohibits actions (lack of actions) of an economic entity that has dominant position, which result or can result in preventing, restricting or eliminating competition and (or) infringing the interests of other entities (persons).
The Novosibirsk OFAS Russia recognized that "SibirEnergo" OJSC violated Part 1 Article 10 of the Federal Law "On Protection of Competition". In accordance with Article 14.31 of the Code of the Russian Federation on Administrative Violations, the Novosibirsk OFAS Russia imposed a fine in the amount of one hundredth of the proceeds gained by the company for supplying electrical energy, or 75 786 920 Rubles.
