FAS Recognized Subuglemet Holding Violated Law
OREANDA-NEWS. December 09, 2008. The Federal Antimonopoly Service (FAS Russia) recognized that the group of persons including "Subuglemet Holding" Ltd., "Subuglemet" CJSC, "Mezhdyrechye" OJSC, "OF Mezhdurechenskaya" CJSC, "Antonovskaya "OF" CJSC violated Clause 1 Part 1 Article 10 of the Federal Law "On Protection of Competition" (abusing dominant market position by fixing and maintaining monopolistically high goods prices), reported the press-centre of FAS Russia.
The case against "Subuglemet Holding" Ltd. was initiated upon petitions from several consumers as well as the result of the analysis by FAS Russia of the situation on the market of coking colas in the Russian Federation.
The group of persons of "Subuglemet Holding" Ltd. violated the antimonopoly legislation by fixing and maintaining monopolistically high goods prices for the concentrate of coking coal of close-burning grades.
Investigating the case, FAS Russia did not reveal any violations by the company of Clauses 5 and 8 Part 1 Article 10 of the Federal Law "On Protection of Competition". Thus, the antimonopoly authority did not confirm the facts that companies - members of the group of persons of "Subuglemet Holding" Ltd. refused without any economic or technological justification to enter into contracts for supplying coal concentrate and created discriminatory conditions for individual consumers of coal concentrate.
Under Article 14.31 of the Code of the Russian Federation on Administrative Violations, abusing dominant position is punishable by administrative fines upon legal entities in the amount 1 - 15% of the net sales of the violators on the market, where the violations occurred, in the year preceding the year, when the violation was revealed but no more than 2% of the net sales of all goods.
FAS Russia will issue the decision and determination on the case within the statutory period.
Earlier FAS Russia fined the group of persons "Mechel", "EvrazHolding" and "Raspadsky Ugol" for the total amount over than a billion Rubles for abusing dominant position on the market of coking coal.
