OREANDA-NEWS. December 01, 2008. Under the Code of the Russian Federation on Administrative Violations, "turnover fines" for antimonopoly violations are determined on the basis of the net proceeds of the violator in the calendar year preceding the year when the violation was revealed, reported the press-centre of FAS Russia.

Taking into consideration the current economic situation and changes in financial situation of economic entities, including the ratio of companies' proceeds in the current and the last year, the Federal Antimonopoly Service (FAS Russia) recommended that its regional offices to determine the base amount of administrative fines for antimonopoly violations, calculated from the net sales of the company in 2007, using the coefficient that halves the calculated amount of the administrative fine. Making the decision, FAS Russia was referring to Part 3 Article 4.1 of the Code of the Russian Federation on Administrative Violations.

The administrative fine cannot be less than 1 % of the net sales of the goods on the market where the violations occurred in the year preceding the year when the violations was revealed.
