OREANDA-NEWS. On November 13, 2008 the Federal Antimonopoly Service (FAS Russia) recognized that the "Yakutsk Airport" State Unitary Enterprise and the Ministry of Transport, Communication and Informatization of the Sakha (Yakutiya) Republic violated Article 16 of the Federal Law "On Protection of Competition" (concerted actions) and issued a determination to eliminate the violations. FAS Russia also recognized that the "Yakutsk Airport" State Unitary Enterprise violated Article 10 of the Federal Law "On Protection of Competition" (abusing dominant position on the goods market), reported the press-centre of FAS Russia.

Investigating the case, FAS Russia established that during a long period the "Yakutsk Airport" State Unitary Enterprise unreasonably refused to offer the requested slots to "INTERAVIA" Air Carrier" Ltd. for regular flights on the Moscow -Yakutsk - Moscow route through Yakutsk airport and to conclude the ground handling contract with the company. Explaining its actions, the "Yakutsk Airport" State Unitary Enterprise stated that the demand on this route was fully satisfied.

Actions/lack of actions of the "Yakutsk Airport" State Unitary Enterprise resulted in restriction of competition on the market of air transportation on the Moscow -Yakutsk - Moscow route and infringing the interests of "INTERAVIA".

The Ministry of Transport, Communication and Informatization of the Sakha (Yakutiya) Republic jointly with the "Yakutsk Airport" State Unitary Enterprise sent a letter to the Head of Rosaviatsiya (the Federal Air Transport Agency), stating that due to satisfied passenger demand on the Moscow -Yakutsk - Moscow route and absence of aviation fuel in the airport, in order to avoid failures for cargo and passenger transportation, the services to "INTERAVIA" would have to be terminated on 30th November 2007.

The letter manifests concerted actions between the Ministry of Transport, Communication and Informatization of the Sakha (Yakutiya) Republic and the "Yakutsk Airport" State Unitary Enterprise, which can restrict entry to the market of air transportation on the Moscow -Yakutsk - Moscow route and eliminate "INTERAVIA" Air Carrier" Ltd. from the market.
