OREANDA-NEWS. On September 24, 2008 the Federal Antimonopoly Service (FAS Russia) fined "Vnukovo-Invest" CJSC 1'786'416 roubles for the abuse of dominant position in the markets of parking services, reported the press-centre of FAS Russia.

To remind, earlier the FAS Russia initiated cases against "BRK Invest Limited" CJSC, "Domodedovo Aerotel" CJSC and "Vnukovo-Invest" CJSC for violation of the Article 10 of the Federal Law "On Protection of Competition" (abuse of dominant position).

These cases were initiated as a result of the inspections conducted by the FAS Russia and the Moscow Regional Office of the FAS Russia in the Moscow airports "Sheremetevo", "Domodedovo" and "Vnukovo". The inspections were caused by the claims of consumers on the high parking prices in the airports as well as on the necessity to pay for the whole hour even if the parking time was less.

As a result of the analysis of the market of temporary parking of vehicles in the airports as well as materials collected by the inspectors the following was revealed: the companies provide services on the territory of the given airports and have dominant position in the markets of the relevant services.

The FAS Russia acknowledged that "Vnukovo-Invest" CJSC had violated Clauses 1 and 3 Part 1 Article 10 of the Federal Law "On Protection of Competition" by setting monopolistically high price on the parking services and infringing consumers' interests through imposing on the counterparty of payment terms which were unprofitable for the latter (payment for the whole hour if the parking time is less).

The Article 14.31 of the Code of the Administrative Violations of the Russian Federation envisages the administrative liability by imposing fine from 1 to 15% of the company' proceeds in the market where the violation occurred.
