OREANDA-NEWS. On July 25, 2008 the Office of the Federal Antimonopoly Service in the Kurgan region (OFAS Russia) fined "Unimilk" Ltd. 16 170 000 Rubles under Article 14.32 of the Code of the Russian Federation on Administrative Violations for breaching the Federal Law "On Protection of Competition", reported the press-centre of FAS Russia.

Earlier Kurgan OFAS Russia inspected compliance with the antimonopoly legislations on the market of milk products.

In course of the inspection the antimonopoly body established that "Unimilk" Ltd., in the person of its subsidiary "Unimilk - Shadrinsk", entered into a distribution agreement on supplying milk products to the distributor exclusively for further reselling to the customers. According to the agreement, the distributor was obligated to agree in writing on the prices for milk products for further reselling them to the customers within the territory and under conditions set in the agreement. Such provisions violated the antimonopoly legislation.

Kurgan OFAS Russia recognized that "Unimilk" Ltd. breached Part 2 Article 11 of the Federal Law "On Protection of Competition" and issued a determination to amend the distribution agreement. "Unimilk" Ltd., in the person of its subsidiary "Unimilk - Shadrinsk", disagreed with the decision of the antimonopoly body and filed a claim to the Kurgan Regional Arbitration Court. However, the Courts of the First and Appeal Instance confirmed the rightness of Kurgan OFAS Russia.
