OREANDA-NEWS. July 28, 2008. The Novosibirsk Office of the Federal Antimonopoly Service (OFAS Russia) recognized that "Tolmachevo Airport" OJSC violated the Federal Law "On Protection of Competition" and issued a determination to stop the violations, according to which the airport must provide unimpeded access to the market of fuel-and refilling services, reported the press-centre of FAS Russia.

The airport violated the law by restricting competition and infringing the interests of "Airjet - Tolmachevo" Ltd. The airport groundlessly refused to issue entry-passes to "Airjet - Tolmachevo" Ltd. for the passage of its special equipment and personnel to the airfield apron, which made impossible refueling of the company's aircrafts.

Clause 9 Part 1 Article 10 of the Federal Law "On Protection of Competition" forbids actions (lack of actions) of an economic entity with dominant position, that result or may result in preventing, restricting or eliminating competition and (or) infringing the interests of other persons, particularly, impeding access of other economic agents to the goods market.

The above statutory requirement is applicable to "Tolmachevo Airport" OJSC because "Tolmachevo Airport" OJSC is included in the Register of economic entities with over 35% share on the market of particular goods for the services of "aircraft taking off - landing", "servicing air passengers", "aircraft technical maintenance" with over 65% share, and is also included in the Register of transport natural monopolies for the airport services.

Therefore, "Tolmachevo Airport" OJSC violated the Federal Law "On Protection of Competition" by impeding the access of "Airjet - Tolmachevo" Ltd. to the market of aircraft refueling services. The Novosibirsk OFAS Russia issued a determination to the airport requesting it to eliminate the antimonopoly violation and give the entry-passes, as well as organize training and placements of the personnel of Airjet - Tolmachevo Ltd.
