OREANDA-NEWS. July 17, 2008. The Federal Antimonopoly Service (FAS Russia) imposed administrative charges upon "BPK Invest Limited" CJSC and "Domodedovo Airhotel" CJSC -2 700 000 Ruble and 11 055 429.23 Ruble fines accordingly for abusing dominant position, reported the press-centre of FAS Russia.

On 28th May 2008 FAS Russia recognized that "BPK Invest Limited" CJSC, "Domodedovo Airhotel" CJSC and "Vnukovo-Invest" OJSC breached Part 1 Article 10 of the Federal Law "On Protection of Competition" (abusing dominant position).

The cases against the companies were initiated upon inspections of the parking services in Sheremetyevo, Domodedovo and Vnukovo airports, carried out jointly by FAS Russia and the Moscow Office of FAS Russia. The inspections were organized due to citizens' complaints on high parking prices in the airports and rounding the payment time for parking by an hour.

It was established that "BPK Invest Limited" CJSC, "Domodedovo Airhotel" CJSC and "Vnukovo-Invest" OJSC offer the services of short-term parking in the above airports and have dominant position on the market of such services.

"BPK Invest Limited" CJSC violated the antimonopoly legislation by abusing its dominant position, particularly, infringing the interests of the users of car parking services by imposing unfavorable payment conditions (rounding the payment time by an hour).

As for "Domodedovo Airhotel" CJSC and "Vnukovo-Invest" OJSC, along with the above-mentioned violations, the companies also fixed and maintained monopolistically high prices.

In accordance to the Federal Law "On Protection of Competition" such violations are administratively liable in form of turnover fines (Article 14.31 of the Code of Administrative Violations).

Under Article 14.31 of the Code of Administrative Violations, if an economic entity with dominant position on the goods market is engaged in the actions which are classified as abusing dominant position and are forbidden by the antimonopoly legislation of the Russian Federation, such actions are punishable by imposing administrative fines on legal persons - 0.01 - 0.15 of the proceeds gained by the violator from selling the goods on the market, where the violation took place, in the calendar year preceding the year of the violation.

"BPK Invest Limited" CJSC was fined 2 700 000 Rubles for committing the administrative violation and "Domodedovo Airhotel" CJSC - 11 055 429.23 Rubles.
