OREANDA-NEWS. April 15, 2008. The Federal Antimonopoly Service (FAS Russia) terminated the administrative proceedings against "Alcoa Rus" Ltd. The case was initiated upon company's failure to fulfill the determination, issued by the antimonopoly body, to carry out competition-promoting actions with regard to the control transactions over "Samara Metal Works" OJSC and "Belokalitvensk Metallurgical Production Association" OJSC, reported the press-centre of FAS Russia.

Under Clause 1 of the determination, the Alcoa Group was obliged to continue executing all short-term and (or) long-term contracts, orders and agreements of the acquired "Samara Metal Works" OJSC and "Belokalitvensk Metallurgical Production Association" OJSC, valid on the date of acquiring the above companies, in accordance with their terms, including the contracts related to the state defence procurements, special federal space and aviation programmes and other federal governmental needs.

In pursuance of the contract with с "Aviastar-SP" CJSC and under the contract signed between the Alcoa Group and "Oboronpromcomplex" Public Corporation" OJSC for supplying aluminum products required for special federal space and aviation programmes and for other federal governmental needs, "Oboronpromcomplex" Public Corporation" OJSC sent an application to "Alcoa Rus" Ltd. for supplying aluminum products in 2008 for the needs of "Aviastar-SP" CJSC которая не принималась к исполнению "Alcoa Rus" Ltd.

Therefore, actions by "Alcoa Rus" Ltd. violated Part 6 Article 34 of the Federal Law "On Protection of Competition".

According to the explanations given by "Alcoa Rus" Ltd., currently the application of "Oboronpromcomplex" Public Corporation" OJSC is allowed to proceed.

Taking into consideration that the application is allowed to proceed, and the fact that the delay has not affected timely supplies for "Aviastar-SP" CJSC, FAS Russia has concluded to termination the proceedings on the administrative case.
