OREANDA-NEWS. February 28, 2008. The Federal Arbitration Court of the Moscow District allowed a cassation appeal of the Federal Antimonopoly Service (FAS Russia) regarding "Silvinit" OJSC, reported the press-centre of FAS Russia. 

On 23rd April 2007, FAS Russia recognized that "Uralkalii" OJSC and "Silvinit" OJSC breached Clause 1 Article 10 of the Federal Law "On Protection of Competition" (abusing dominant position).

"Uralkalii" OJSC и "Silvinit" OJSC breached the antimonopoly legislation by setting monopolistically high prices for potassium chloride in 2007 on the market of the Russian Federation.

Having considered the case, FAS Russia issued determinations to "Silvinit" OJSC and "Uralkalii" OJSC requesting the companies to transfer to the federal budget the income, gained due to antimonopoly violations, in the amount of 127 013 800 Rubles and 62 165 483 Rubles accordingly.

"Silvinit" OJSC disagreed with the decision and determination of the Antimonopoly Authority and appealed. The Moscow Arbitration Court revoked the decision of the Antimonopoly Authority.

Having considered the case, the Federal Arbitration Court of the Moscow District agreed with the arguments presented by the Antimonopoly Authority and remanded the case for reconsideration to the Court of First Instance.
