Golos Rosii Broke Federal Law
OREANDA-NEWS. January 28, 2007. The Federal Antimonopoly Service (FAS Russia) sent to the "Russian State Broadcasting Company "Golos Rosii" Federal State Institution (the ordering party) and "VSU ХХI vek" United Group of Companies" Ltd. (the petitioner) its decision regarding a complaint that the broadcasting company breached the Federal Law "On State and Municipal Procurement of Goods, Works and services" in an open tender for major maintenance of its building, reported the press-centre of FAS Russia.
FAS Russia found that the complaint was unjustified; however, in course of an off-schedule inspection the Antimonopoly Service revealed some violations of the state procurement legislation.
In particular, it established that the significance of the criterion on the "quality of work" exceeded 20%, which contravened Part 6 Article 28 of the Federal Law "On State Procurement…". Moreover, collateral value of execution of the government contract was smaller than the advanced payment, which was in breach of Part 4 Article 22 of the Federal Law "On State Procurement…"
FAS Russia initiated administrative proceedings against responsible officials of the ordering party. Under Part 4 Article 7.30, and Part 1 Article 7.32 of the Code of Administrative Violations of the Russian Federation they can be fined 50 000 Rubles each.
