Russian Railways Will not Violate the Antimonopoly Legislation
OREANDA-NEWS. January 09, 2007. The Federal Antimonopoly Service (FAS Russia) recognized that the "Russian Railways" Open Joint-Stock Company ("RZhD" OJSC) breached Part 1 Article 10 of the Federal Law "On Protection of Competition" (creating discriminatory conditions for economic entities and preventing their entry to the goods market) on the market of roundhouse servicing and capital maintenance of freight cars, reported the press-centre of FAS Russia.
The case was initiated upon the petitions of "Soyuzgruzpromtrans" non-for-profit association, enclosures to which included complaints made by several economic entities, which use services of "RZhD" OJSC, companies-operators as well as Irkutsk and Krasnoyarsk Regional Offices of FAS Russia.
"RZhD" OJSC violated the law by abusing its dominant position on the market of rolling stock repair: providing unequal access to the railway transport repair and maintenance capacities.
The FAS Russia Commission investigated the case in accordance with the established procedures; analysis and evaluation of competitive environment on the market of roundhouse servicing and capital maintenance of freight cars confirmed that "RZhD" OJSC holds the dominant position.
Having considered the case, FAS Russia issued a determination to "RZhD" OJSC requesting the company to stop violating the antimonopoly legislation.
