OREANDA-NEWS. On October 25, 2007 the Federal Antimonopoly Service (FAS Russia) made a decision and determination regarding the case against "Zavolzhsky Motor Plant" CJSC ("ZMP" OJSC). FAS Russia requested the company to stop violating Part 3 Article 11 of the Federal Law "On Protection of Competition" in terms of co-coordinating economic activities by means of the agreements, binding dealers to prevent the products of "ZMP" competitors from entering the goods markets, reported the press-centre of FAS Russia.

The case was initiated upon the complaints of "NTTs RODOS" Ltd. (the Moscow Region), "Clutch Plant Ltd. (the Tyumen Region) and "Inform-Avto" Ltd. (the Nizhny Novgorod Region).

The antimonopoly legislation was breached by including certain provisions to №1 Supplementary Agreements to the Dealer Contract, according to which dealers were instructed "not to buy, sell or store competitors' products" under the threat of losing their discounts.

Upon considering the case, FAS Russia recognized partial elimination of the violations by "ZMP" OJSC that introduced amendments to the dealer agreements on 1st June 2007. Hence, FAS Russia issued a determinations towards complete termination of the violations and preventing further practice of competition restricting agreements.

FAS Russia intends to devise and recommend a draft standard dealer agreement to all carmakers in the near future.
