Press-release of FAS Russia on Federal Customs Service Published
OREANDA-NEWS. On October 19, 2007 the Federal Antimonopoly Service (FAS Russia) issued a decision on recognizing that the Federal Customs Service (FCS) violated Part 2 Article 12 of the Federal Law "On State and Municipal Procurement of Goods, Works, and Services" in the open bidding for supplying computer equipment and peripheral units for FCS on № 1 lot, reported the press-centre of FAS Russia.
The case against FCS was initiated under a complaint of "TK Neotorg" Ltd.
Investigating the complaint, FAS Russia established that the Auction Commission, formed by the ordering party, rejected the bid of "TK Neotorg" Ltd. for participating in the auction on the grounds of presenting avaricious information.
The ordering party, however, failed to present the documents, confirming that "TK Neotorg" Ltd. submitted avaricious information, to the Antimonopoly Service. At the same time, FAS Russia found that the bid in question contained the goods specification that meet requirements set in the auction documentation.
Therefore, the Antimonopoly Service found that the refusal of the Federal Customs Service to reject the auction bid of "TK Neotorg" Ltd. was unjustified.
FAS Russia issued determinations to FCS Russia requesting it to withdraw the Bids Consideration Protocol for № 1 lot and consider the bids according to the procedures specified in the auction documentation and the state procurement legislation.
In addition, FAS Russia initiated administrative proceedings against some officials representing the ordering party.
