Press-release of FAS Russia on «Unscrupulous Suppliers»
OREANDA-NEWS. September 04, 2007. Currently over 150 economic entities are included into the Register of unscrupulous suppliers, which has been administered by the Federal Antimonopoly Service (FAS Russia) jointly with the Federal Service on Defence Procurement (Rosoboronzakaz) since August 2007, reported the press-centre of FAS Russia.
Under the Federal Law "On State and Municipal Procurement of Goods, Works and Services", the Register should contain information about the offering participants, who avoided entering into a state or municipal procurement agreement, as well as the suppliers (executors, or contractors) state or municipal agreements with whom were terminated due to significant breach of contractual terms and conditions.
If the authorized federal executive body receives information that an offering participant attempted to avoid entering into a state or municipal procurement agreement and there are no confirming documents, it must verify the fact of avoidance. If such information is confirmed, the authorized federal executive body must entry information about the company into the Register of unscrupulous suppliers.
Considering the issue of including a company into the Register of unscrupulous suppliers, FAS Russia simultaneously checks if the ordering party observed the state procurement legislation.
"When approaching FAS Russia, the ordering parties should understand that we will also check their actions on placing the order in question", - said the Head of the FAS Russia's Department for Control of State Procurement, Mikhail Yevraev.
According to Mikhail Yevraev, "if the documents confirming the violations committed by the offering participant are incomplete or ambiguous, we would always carry out a thorough inspection, inviting both the ordering party and the supplying company. All unconfirmed facts are interpreted to the benefit of the supplier's integrity".
Companies, that are included into the Register, will be forbidden to bid during two-year period, should an ordering party specify such a requirement in the order placement terms and conditions. It means that the ordering parties now have a new instrument to protect themselves from unscrupulous companies.
