Judgment Regarding Complaint of O.L.Gavrilenko to FAS Russia
OREANDA-NEWS. On July 27, 2007 the Presnensky District Court, Moscow, announced its judgment regarding the complaint of the Head of the Department of the Federal Service on Consumer Rights and Human Well-Being in the Moscow Region, Mrs O.L.Gavrilenko, against the resolution of Deputy Head of FAS Russia, Mr A.G.Tsyganov, on imposing a fine for an administrative offence, reported the press-centre of FAS Russia.
On 3rd May 2007, FAS Russia imposed an administrative fine on the Head of the Moscow Regional Department of Rospotrebnadzor for failure to present information upon a request of the antimonopoly authority.
Prior to this, FAS Russia had sent a letter requesting the Moscow Regional Department of Rospotrebnadzor to present information necessary to consider a case on breaching the antimonopoly legislation.
The requested information, however, was not presented to FAS Russia, which is liable to administrative charges under Part 2 Article 19.8 of the Code of Administrative Violations.
Having considered the case, FAS Russia issued a resolution on administrative charges against the Head of the Moscow Regional Department of Rospotrebnadzor in form of a fine amounted to 25 minimum monthly wages, or 2 500 Rubles.
Mrs Gavrilenko disagreed with the resolution issued by the antimonopoly authority and appealed.
The Court dismissed the complaint of Mrs Gavrilenko. FAS Russia's resolution was pronounced fully valid.
