OREANDA-NEWS. On May 17, 2007 the Commission of the Federal Antimonopoly Service (FAS Russia) came to a conclusion that Rospotrebnadzor, its offices in Moscow and the Moscow Region, the "Moscow Hygiene and Epidemiology Centre" Federal State Health Agency (FGUZ) and the "Moscow Regional Hygiene and Epidemiology Centre" FGUZ violated Clauses 2 and 5 Part 1 Article 15 of the Federal Law "On Protection of Competition", reported the press-centre of  FAS Russia.


The violation is described as unreasonable prevention of activity of economic entities which are authorized to carry out sanitary - epidemiological examination of alcoholic beverages as well as to compile the restricted list of economic entities that may offer such services to the beneficiaries. The Commission of FAS Russia issued determinations to the above organizations requesting them to eliminate violations of the antimonopoly legislation. The defendants once again did not attend the case proceedings at FAS Russia.


Earlier FAS Russia had imposed administrative fines upon the heads of the Rospotrebnadzor offices in Moscow and the Moscow Region and the "Moscow Hygiene and Epidemiology Centre" FGUZ for failure to submit information necessary for proper consideration of a case on violation of the antimonopoly legislation. Representatives of the above organization also failed to appear at the consideration of their cases on administrative violations at FAS Russia.


Furthermore, FAS Russia instituted proceedings on administrative violations against the heads of Rospotrebnadzor and the heads of Rospotrebnadzor offices in Moscow and the Moscow Region, the "Moscow Hygiene and Epidemiology Centre" FGUZ and the "Moscow Regional Hygiene and Epidemiology Centre" FGUZ for repetitive failure to submit information requested by the federal antimonopoly authority. Decision and determination on the case will be issued according to the statutory procedures.
