OREANDA-NEWS. On May 11, 2007 the Federal Antimonopoly Service (FAS Russia) found that the Federal Tax Service (FNS) breached the Federal Law "On State and Municipal Procurement of Goods, Works and services" in organizing a public bidding for antivirus software user license for working stations and servers, reported the press-centre of FAS Russia.


The case against FNS was initiated following a petition of "LETA Programnoye Obespechenie [Software]" Ltd. whose bid was rejected on the grounds that it did not comply with the requirements set in the tender documentation. In particular, the "goods description" section of the bid did not contain a confirmation that the offered software was compatible with the one specified into the tender documentation.

Having analyzed the case, however, FAS Russia found the bid conforming to the requirements specified in the tender documentation. Therefore, the Federal Tax Service unreasonably rejected the bid of "LETA Programnoye Obespechenie "Ltd. and breached Part 2 Article 12 of the Federal Law "On Procurement…". As a result, FAS Russia requested to withdraw the Tender Consideration, and Evaluation and Comparison Reports.
