OREANDA-NEWS. May 15, 2007. Yesterday for the first time in history of Kuzbas in arbitration the order of carrying out of auction on the right of development of a site of a coal deposit is challenged. Kemerovo Open Company " KMU " Sibstalkonstruktsija " " has addressed with the appl ication in which affirmed, that the territorial agency on nedropolzovaniju (Kuzbassnedra) has wrongfully given up to it in participation in auction on site Spichenkovskij, as a result got to group " Strojservis ". The arbitration has rejected the claim, b t "Sibstalkonstruktsija" is measured to challenge this decision in appeal instance.

At yesterday's session of arbitration court of the Kemerovo area the representative of Open Company " KMU " Sibstalkonstruktsija " " (is engaged in autotransportations of coal, has the license for extraction of gold in Mountain Altai) Dmitry Bondarev has informed, that the company asks to recognize mismatching the law order Kuzbassnedr on refusal of Open Company to participate in auction on site Spichenkovskij and to accept the application anew. The challenged order has been published for two weeks before auction. On April, 5th before tendering head Kuzbassnedr Alexander Mamlin has declared, that from five submitted applications the agency has rejected three from legal persons who have not presented proofs of possession sufficient means and qualified perso nnel for development of a site. There were rejected applications from Open Company " Operating company " Sibkoul " " (Prokopevsk), Open Company " KMU " Sibstalkonstruktsija " " and Open Company " Coals of Siberia and To " (Mezhdurechensk).
