OREANDA-NEWS. On May 07 the Federal Antimonopoly Service (FAS Russia) found that the complaint of "Priroda-EKO" Ltd. against the actions of the ordering party - the Federal Highway Agency (Rosavtodor), undertaken in the open bidding for maintenance works in the Rosavtodor building, was justified, reported the press-centre of FAS Russia.
FAS Russia requested the ordering party to withdraw the protocols of bids consideration and opening and introduce amendments to the tender documentation.


Rosavtodor must introduce amendments to the tender documentation to meet requirements of the state procurement legislation and extend the request period for 20 days after the appropriate amendments are published. FAS Russia established that tender documentation did not specify procedures for bids assessment and comparison as well as criteria weighting and, therefore, breached Part 7 Article 65 of the Federal Law of the Russian Federation "On State and Municipal Procurement of Goods, Works and Services". Furthermore, the antimonopoly authority found that the procurer requested the bidders should submit certain documents beyond the requirements of the Federal Law "On Procurement …".


On these grounds, one of the companies that submitted the bid was not allowed to participate in the tender. Such actions of the tender commission violated Part 6 Article 11 and Parts 3 and 4 Article 25 of the Federal Law "On Procurement …".
