OREANDA-NEWS On October 30, the Moscow Arbitration Court extended the bankruptcy procedure of Radio Liberty (RFE/RL, the media corporation is recognized in Russia as a foreign agent and an undesirable organization, LLC is its Russian legal entity) until June 30, 2025.
In the definition on the court's website, the specific date of the next report of the bankruptcy trustee of RCE/RS LLC, Yulia Aga-Kulieva, is not indicated.
The document notes that "the absence of a reasoned request for an extension of the procedure is the basis for appointing a court session in order to verify the validity and reasonableness of the period during which the bankruptcy proceedings are carried out by the manager, as well as the basis for issuing a private ruling against the manager."
On December 26, 2023, the bankruptcy trustee of the RFE/RS filed an application with the court to bring the persons controlling the debtor to subsidiary liability.
In the framework of the bankruptcy case of RCE/RS LLC, she, in particular, asks to bring to subsidiary responsibility the former CEO and head of the Russian Service of the media Corporation Andrei Sharogo and Radio Free Europe/Radio Liberty, Inc. (Radio Free Europe/Radio Liberty, RFE/RL, Inc., USA). This meeting has been postponed to June 2, 2025.
The claims are based on the fact that "the actions of the defendants led to the inability to repay debts to creditors, which caused significant damage to the property rights of creditors."
The court introduced the monitoring procedure in relation to the RFE/RS on August 15, 2022, at the request of the Moscow inspectorate of the Federal Tax Service of Russia No. 7 due to the radio station's tax debt amounting to more than 6 million rubles. The company was declared bankrupt on March 13, 2023.
On July 5, 2023, the court included in the register of creditors of RCE/RS LLC the claim of the Federal Tax Service of Russia No. 7 in Moscow in the amount of 223.5 million rubles. The court's ruling explains that "the debtor has an unfulfilled obligation to pay mandatory payments, which is confirmed by [management's] notifications Roskomnadzor (RCN) for the Central Federal District" dated October 14, 2022 and October 26, 2022. The debt is also confirmed by the decisions of the Tverskoy District Court of Moscow that have entered into force on bringing the debtor to administrative responsibility.
In relation to the RFE/RS and the CEO of its Russian legal entity have drawn up more than 1,000 protocols since January 2021 for the lack of labeling of materials of its projects, the RCN previously informed Interfax. According to court decisions, the organization was brought to administrative responsibility for a total amount of about 785 million rubles.
In addition, as Interfax reported, in 2022, the world court considered several dozen protocols against the RFE/RL for refusing to delete information recognized as fake about the military operation in Ukraine. The amount of fines under these protocols has already amounted to 75.8 million rubles.
Thus, the amount of fines imposed by the RFE/RL amounted to more than 1.064 billion rubles.
"Due to the systematic placement of information materials containing false information about a special military operation on the territory of Ukraine, access to a number of information resources of Radio Free Europe LLC/Radio Liberty was restricted," the RCN recalled earlier.
The RFE/RS accounts were blocked on May 14, 2021 at the request of the FSSP. The Moscow edition of Radio Liberty moved to Riga in 2022.
