OREANDA-NEWS. December 30, 2011. The Ministry of Economic Development and Trade of Ukraine has developed a series of regulations aimed at implementing the Law of Ukraine "On State Market Supervision of Non-Food products" and to protect consumers' rights about quality and product safety. The relevant documents approved by the Cabinet of Ministers on December 26, 2011.

In particular, the Ministry initiated amendments to some laws of Ukraine on the creation of a national body of standardization and procedures for developing and adopting standards. Thus, it is expected to improve the organizational structure of national standardization system, joining the national standardization body and stating that the central executive body that form and implement the national policy in standardization, is the coordinator in standardization at the interdepartmental level.

Functions of national standardization body were provided to give the state enterprise "Ukrainian Research and Training Center for standardization, certification and quality," which is not a state authority. Enterprise is offered to give such powers as the organization, coordination and implementation activities for the development, adoption, revision, alteration, cancellation, distribution of national standards; representation of Ukraine in international and regional organizations for standardization. Also planned to expand the scope of the Law of Ukraine "On standardization", joining the construction and building materials industry.

However, the Ministry prepared a draft law of Ukraine "On Amendments to Certain Laws of Ukraine", which proposes to determine the mechanism of handling, which according to the Law of Ukraine "On consumer rights protection" withdrawn from sale, and strengthen the responsibility for putting into circulation counterfeit products. The Bill also introduces amendments to the Law of Ukraine "On Fundamentals of State Supervision (Control)".

In addition, it was established the Coordination Council for quality and safety of human life, as a temporary advisory body under the Cabinet of Ministers of Ukraine, the main objective of which is to identify critical points for the most important directions of the population in order to accelerate convergence of quality and safety of life of citizens to the best European standards.

The Government also approved the Procedure for notification of product which does not meet the general requirement of safety products.

However, the Government approved technique to take restrictive (remedial) measures, which sets out clear and understandable criteria for risk assessment of products to be audited and the conditions and circumstances in which market surveillance authorities choose appropriate restrictive (corrective) measures to be taken.

In addition, it was approved procedure for implementing and destruction of samples used during the examination (test) not food products were selected within the state of market surveillance and Methods of the residual value used during the examination (test) samples of non-food products were selected in within the state of market surveillance. This decision will prevent the spread of the market of particular products (used samples) for which the results of their examination (test) revealed that they are dangerous and/or do not meet the requirements of technical regulations, to determine accounting procedures, storage, evaluation and disposal of a types of property that becomes the property of the state.

Also it was approved by order of the state market surveillance monitoring causes and number of complaints consumers (users) on the protection of their right to safety of non-food products, and causes of accidents and incidents causing harm to human health due to consumption of non-food products.
